Many business negligence cases hinge on the extent to which a party does (or does not) exercise appropriate business risk management for the operations they oversee. In addition to the laws and case precedents that guide court decisions, these cases often require intense investigation into the standards of care and oversight that exist within the relevant industries. In many cases, a failure to adequately monitor industry benchmarks across competitive and geographical boundaries can spell disaster for companies facing lawsuits. Additionally, careful authoring of company risk management policies, and consistent adherence thereto, can create significant liability for even the largest companies. Competent risk management planning, including careful risk identification and mitigation, can make or break the success of a business in defending against negligence or tort litigation. Studies have shown that thorough and comprehensive risk management programs can easily pay for themselves in the amount of money they save the companies that use them. But the converse is also true…failure to adopt a well-developed company risk management program can bankrupt a business.
